1. Purpose and acceptance

These Terms of Service govern the use of the Geo Catch mobile app and the geocatch.app website (together, the "Service").

These Terms apply to the following app:

Geo Catch — com.geocatch

By downloading, installing or using the Service you accept these Terms. If you do not agree with them, do not use the Service.

3. Minimum age

The Service is intended for users aged 14 or over.

If you are under 14, you may not use the Service.

If you are between 14 and 17 years old, you declare that you have the authorisation of your parents or legal guardians where required under applicable law.

Parents or legal guardians are responsible for supervising the use of the Service by the minors in their care, under the terms established by applicable law.

4. Use of location

To get coordinates, show your position on the map, track your route or use the compass, the app needs access to your device location and sensors, with your permission. You can withdraw that permission at any time from your device settings.

Your location is processed on the device itself and is not sent to our servers. To display the map, the app downloads images from OpenStreetMap, which receives your device IP address.

5. Saved locations and exports

The app does not require an account. The locations you save, their names and categories are stored only on your device.

If you uninstall the app or clear its data, they are lost and we cannot recover them. You can back them up by exporting them to a file (GPX, KML, GeoJSON, CSV, JSON and other formats); you are responsible for the files you export and share.

6. Safety and accuracy

Coordinates, distances, areas, altitudes and compass directions are approximate: their accuracy depends on the GPS, the device sensors and the surroundings.

Do not use the Service for navigation in critical, emergency or rescue situations, or as your only means of orientation.
Do not use the app while driving or in any way that puts your safety or that of others at risk.
Respect private property, restricted areas and the rules of the place you are in.

7. Sharing coordinates

You can share a location through a link that opens on this website. You decide who you share it with. Do not share other people's location without their consent.

8. Advertising

The Service is free and funded by advertising shown by third-party providers such as Google AdMob.

To export your locations to a file, you may be asked to watch a full ad. If the ad cannot be loaded, the export is carried out anyway.

The processing of data related to advertising is described in the Privacy Policy.

9. Rules of use

When using the Service you agree not to:

Modify, decompile or reverse engineer the app, except as permitted by law.
Use cheats, automation programs or unauthorised software, or circumvent the advertising or features of the Service.
Interfere with the operation of the Service or the website.
Use the Service for unlawful purposes or in ways that harm others.

10. Intellectual property

The Geo Catch app, the website and all their content (code, graphics, text, names and trademarks) belong to their owner or its licensors and are protected by law. These Terms do not transfer any rights over them to you beyond the personal, non-commercial use of the Service.

11. Availability and changes to the Service

We work to keep the Service running properly, but we cannot guarantee that it will be available without interruption or errors. We may add, change or remove features or content.

12. Liability

The Service is provided free of charge. To the extent permitted by law, the owner shall not be liable for the loss of data stored on your device or for indirect damages arising from the use of, or inability to use, the Service.

Nothing in these Terms limits the rights granted to you by applicable consumer protection law, nor excludes liability that cannot be excluded by law, such as in cases of wilful misconduct or gross negligence.

13. Changes to these Terms

We may update these Terms to reflect changes in the Service or in the law. We will publish the new version on this page with its date. If you continue to use the Service after it takes effect, you will be deemed to accept it.

14. Governing law and jurisdiction

These Terms are governed by Spanish law. If you are a consumer, you may bring any claim before the courts of your place of residence and you will keep the protection granted by the mandatory rules of your country of residence.
